The Department of State issued a statement warning that visas will be denied if this intent is identified

The U.S. Department of State, through its Bureau of Consular Affairs, has reaffirmed its position on the misuse of tourist visas by foreign nationals whose primary purpose is to give birth on U.S. soil in order to obtain American citizenship for their newborns.

The agency described the practice as “unacceptable” and emphasized that, under current immigration law, consular officers are authorized to deny visa applications when this intent is identified.

“Foreign parents who seek to enter the United States on a tourist visa solely for the purpose of having their children born in the country to obtain U.S. citizenship are misusing the visa. This practice will not be permitted,” the Bureau of Consular Affairs stated in an official release.

This measure is part of broader efforts by the U.S. government to strengthen immigration enforcement and prevent the fraudulent use of benefits related to citizenship.
